The official language of this site is French. It is subject to French law and to the jurisdiction of the French courts.

3 – Protection of personal data

GO CAPITAL undertakes to use your personal data solely for the purposes of its commercial relationship with its customers. GO CAPITAL therefore guarantees the confidentiality of this data, which will under no circumstances be transferred or made accessible to a third party. 4 – Customer complaints handling policy

A “complaint” is a statement of a client’s dissatisfaction with the management company. It is important to note that a request for information, advice, clarification, service or performance is not a claim.

GO CAPITAL has set up a customer complaints management system designed to handle customer complaints efficiently, objectively, transparently and free of charge. Its aim is to ensure the protection and primacy of the interests of the Management Company’s clients, in accordance with the general principles set out in AMF instruction no. 2012-07.

This system applies to all customers, regardless of the nature of the products they subscribe to.

We advise you to send your request by registered letter with acknowledgement of receipt in order to guarantee the smooth running of the procedure, and ask you to indicate the reason for your complaint in the subject line of your letter.

GO CAPITAL undertakes to acknowledge receipt of your complaint within ten working days, unless the response itself is provided within this period, and to respond to your complaint within a maximum of 60 days from the date of dispatch, unless special circumstances arise and are duly justified.

GO CAPITAL will do its utmost to provide you with a response as soon as possible. In addition, if the complexity of the resolution means that this deadline will be exceeded, the Management Company will give you prior notice.

 

5 – Mediation by the Autorité des Marchés Financiers (French Financial Markets Authority)

All customers may have recourse to a mediator if they are not satisfied with the response to their complaint. You can contact the mediator in writing at the following address:

6 – Policy for preventing and managing conflicts of interest

A conflict of interest is defined as a situation in which the interests of the Management Company or its employees are, directly or indirectly, in competition with the interests of its funds, their holders or principals.

The prevention and management of conflicts of interest at GO CAPITAL are governed by the general principles set out in the French Monetary and Financial Code and the General Regulations of the Autorité des Marchés Financiers (AMF), which specify the following obligations for the Management Company:

Establish a policy for managing conflicts of interest

Detect situations of conflict of interest
Keep a register of actual or potential conflicts of interest
Inform subscribers when conflicts cannot be resolved.

Our policy for preventing and managing conflicts of interest consists of defining procedures for detecting and managing conflicts that may arise in the course of our business activities.

The aim of this policy is to ensure the protection and primacy of the interests of unitholders in the various funds and mandates we manage.

7 – Intellectual property and counterfeiting

GO CAPITAL is the owner of the intellectual property rights or holds the rights of use on all the elements accessible on the site, notably texts, images, graphics, logos, icons, sounds and software. Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, whatever the means or process used, is forbidden, except with the prior written authorization of the editor. Any unauthorized use of the site or the elements it contains will be considered as constituting an infringement and will be prosecuted in accordance with the provisions of articles L.335-2 et seq. of the French Intellectual Property Code.

 

8 – Shareholder engagement policy

GO CAPITAL’s policy on the exercise of voting rights is based above all on the principles of corporate governance and transparency of information provided by the portfolio company.

Voting at shareholders’ meetings depends on the specific analysis of each of the resolutions proposed by the company’s governing bodies, and their potential impact on the development of the company and its business.

The Management Company’s policy is :

to act in the exclusive interest of unitholders, in compliance with the Fund regulations and applicable conflict-of-interest rules,
to ensure that information provided to shareholders is transparent and that it is communicated in a timely manner, in accordance with the shareholder’s right of disclosure,
to ensure that the powers of the Annual General Meeting are maintained.

GO CAPITAL takes part in voting at the general meetings of companies in the portfolios of the funds it manages, regardless of the percentage of shares held or voting rights held.
